In this paper the current legislative landscape and the challenges researchers face in obtaining informed consent in acute situations are explored. In such situations, some current guidelines can be difficult or impossible to apply. Capacity should be formally assessed before consent is sought to ensure that vulnerable persons are neither inappropriately recruited to a study nor denied the opportunity to participate. However, there is little guidance in current legislation as to how this should be achieved. When the patient is considered (...) to be unable to provide prospective informed consent, other forms are sometimes permissible, although all have specific drawbacks. First, it is argued that a brief instrument, suitable for the acute situation, is needed to determine whether patients have the capacity to consent to clinical trials. Secondly, it is argued that there are areas of the informed consent process that require review, and ways that improvements could be made are suggested. (shrink)

The empirical diagnosis presented in this paper is based on interviews with nurse practitioners and physicians designed to elicit their perceptions of the nature and role of ethical dilemmas in clinical practice. Having selected five of these perceptions or views which were common and significant. the philosophical therapy offered consists in, first, a general discussion of ethical dilemmas, and second, a critical analysis of each of the five views with the aim of pointing out confusions and errors, the recognition of (...) which can be of applied and practical help in the clinical setting. In emergency research, obtaining informed consent can be problematic. Research to develop and improve treatments for patients admitted to hospital with life-threatening and debilitating conditions is much needed yet the issue of research without consent (RWC) raises concerns about unethical practices and the loss of individual autonomy. Consistent with the policy and practice turn towards greater patient and public involvement in health care decisions, in the US, Canada and EU, guidelines and legislation implemented to protect patients and facilitate acute research (...) with adults who are unable to give consent have been developed with little involvement of the lay public. This paper reviews research examining public opinion regarding RWC for research in emergency situations, and whether the rules and regulations permitting research of this kind are in accordance with the views of those who ultimately may be the most affected. During the 1980s many communities turned to grassroots activities to promote economic development, rather than relying on industrial recruitment strategies. We evaluate the characteristics of these projects, their benefits and costs, and obstacles they face in the development process. The data are drawn from a survey of more than one hundred communities in the United States. Self-development efforts do not appear to replace traditional rural economic development activities, but may complement them. Self-development activities produce a wide variety of jobs that (...) are taken primarily by local residents. The cost and availability of credit are major obstacles for self-development projects. Although self-development strategies should not be considered the primary economic development strategy for most rural communities, they do enable communities to build a more viable local economy. This essay proposes to view networks as sociocultural structures. Following authors from Leopold von Wiese and Norbert Elias to Gary Alan Fine and Harrison White, networks are configurations of social relationships interwoven with meaning. Social relationships as the basic building blocks of networks are conceived of as dynamic structures of reciprocal (but not necessarily symmetric) expectations between alter and ego. Through their transactions, alter and ego construct an idiosyncratic "relationship culture" comprising symbols, narratives, and relational identities. The coupling of (...) social relationships to networks, too, is heavily laden with meaning. The symbolic construction of persons is one instance of this coupling. Another instance is the application of social categories (like race or gender), which both map and structure social networks. Nor does my review of BertrandRusseli onModalityand LogicalRelevance' suggest that Jan Dejnozka denies or is somehow unaware of this. On the contrary, I assume it to be obvious that any commitment Russell may (...) have had to modal logic must be implicitin his writings, nor explicit. The real issue is whether there is evidence of any such commitment. I will state, briefly,why I remain sceptical. First, Dejnozka's book lacks any interpretive methodology. When the question arises, In whichcontextsis itpermissibleto translateRusseli's language(formal orinformal)intoa modalsystem?, we get the following: amibute a modal logic to Russell if "it is more reasonable than not to paraphrase Russell's thinking into the modal logic." This condition, we are told, "is met to the extent that acertain modal logic is logicallyimplicit in Russell's thinking." All of which goes without saying, but it simply delays the inevitable question: when is a modal logic logicallyimplicit in a text? Dejnozka's current answer: a modal logic is logically implicit in a text when the text logically implies the paraphrase.2 But the final suggestion is incoherent, since we cannot tell what a text logical1y implies until we have discerned its logicalform-i.e. until we havealready paraphrased it into some formal idiom or other. That a modal system captures one or another of Russell's accounts of logical truth in itself entails nothing regarding Russell'sintentions. Finally, we come to Dejnozka's confusions surrounding MDL-the triad of equivalences that underwrite the interpretation of Principiaas a modal logic. In light of Dejnozka's steadfast refusal to formalize the various modal systems he amibmes to Russell, it hardly makes a differencewhether MDLis a modal logic or merely, to use his terminology, a "modal theory" (assuming that the latter ultimately amounts to something other than a modal logic).4What is importam is whether MDLis trivial. In lieu of an abstract, here is a brief excerpt of the content:Photo-credit to Chicago Sun-Times and James Mescall. 4 "The town is beastly and the weather was vile": Bertrand Russell in Chicago, 1938-1939 Visiting Chicago in 1867, Lord Amberley offered his wife an appreciation of the city: "The country around Chicago is flat and ugly; the town itself has good buildings but has a rough unfinished appearance which does not contribute to its attractions."l While Bertrand Russell is known to (...) have accepted and developed particular aspects of his father's thought, it is more likely that his own visits to Chicago, rather than this nineteenth -century appraisal, brought him to the opinion that "the town is beastly and the weather was vile."z One might suppose Russell's longest stay reaffirmed his image of the city suggested in a 1922 article expressing fear of "a slow destruction of the civilization of China" through which "the big towns will become like Chicago."3 Here, Russell appears to have envisioned this city as an amorphous collection of streets and structures manifesting the least desirable values of American capitalism. In his Autobiography a single paragraph is devoted to his 1938-1939 experience of "the bleak hideousness of Chicago" (II, p. 332). Yet there was far more to Russell's six-month sojourn than the little he chose to recall in print. One-half year is a significant period in anyone's life, even for a man who lived ninety-seven (and a half) years. This article, then, presents an account of Russell's coming to and departure from Chicago and his diverse activities while a professor at the University of Chicago. The need to secure some permanent academic position was strongly felt by Russell in the mid-1930s. Finally in the spring of 1937 Russell received a letter from Professor Scott Buchanan who then represented the University of Chicago's Committee on the Liberal Arts (COTLA). Buchanan offered a place on COTLA with only minor teaching duties. Writing to Norton that this "seems a very agreeable job", Russell nevertheless suggested the post "may be reactionary and the sort of thing my radical friends would think I ought not to be connected with. '" it is a committee concerned with a conservative reform of education." But the invitation promised adequate time for independent research, and Russell, quite characteristically, concluded "my wish is to accept, but not if doing so would be wicked" (letter of 30 Apr. 1937). However, Buchanan, having soon thereafter left the University of Chicago for a Maryland college, corresponded no further with Russell. The COTLA job offer was officially withdrawn. Gary Steiner argues that ethologists and philosophers in the analytic and continental traditions have largely failed to advance an adequate explanation of animal behavior. Critically engaging the positions of Marc Hauser, Daniel Dennett, Donald Davidson, John Searle, Martin Heidegger, and Hans-Georg Gadamer, among others, Steiner shows how the Western philosophical tradition has forced animals into human experiential categories in order to make sense of their cognitive abilities and moral status and how desperately we need a new approach to animal (...) rights. Steiner rejects the traditional assumption that a lack of formal rationality confers an inferior moral status on animals vis-à-vis human beings. Instead, he offers an associationist view of animal cognition in which animals grasp and adapt to their environments without employing concepts or intentionality. Steiner challenges the standard assumption of liberal individualism according to which humans have no obligations of justice toward animals. Instead, he advocates a "cosmic holism" that attributes a moral status to animals equivalent to that of people. Arguing for a relationship of justice between humans and nature, Steiner emphasizes our kinship with animals and the fundamental moral obligations entailed by this kinship. (shrink)

In _Animals and the Limits of Postmodernism_, Gary Steiner illuminates postmodernism's inability to produce viable ethical and political principles. Ethics requires notions of self, agency, and value that are not available to postmodernists. Thus, much of what is published under the rubric of postmodernist theory lacks a proper basis for a systematic engagement with ethics. Steiner demonstrates this through a provocative critique of postmodernist approaches to the moral status of animals, set against the background of a broader indictment of (...) postmodernism's failure to establish clear principles for action. He revisits the ideas of Derrida, Foucault, Nietzsche, and Heidegger, together with recent work by their American interpreters, and shows that the basic terms of postmodern thought are incompatible with definitive claims about the moral status of animals--as well as humans. Steiner also identifies the failures of liberal humanist thought in regards to this same moral dilemma, and he encourages a rethinking of humanist ideas in a way that avoids the anthropocentric limitations of traditional humanist thought. Drawing on the achievements of the Stoics and Kant, he builds on his earlier ideas of cosmic holism and non-anthropocentric cosmopolitanism to arrive at a more concrete foundation for animal rights. Masaryk’s philosophical approach to reality is largely characterised by its orientation towards the positivism of Auguste Comte, which Masaryk sought to offset with the psychologism of J. S. Mill. The combination of these positivist approaches became the positive starting point for Masaryk’s ethics. But that was not the only influence on his ethics. Masaryk’s German translation of Hume’s book, titled Eine Untersuchung über die Prinzipien der Moral von David Hume (1883), reveals that the main stimuli that shaped Masaryk’s ideas about (...) ethics came from David Hume. Although the need for scientific evidence became a fundamental principle of Masaryk’s thought, the need to objectively anchor ethics in rational theism necessitated in this area a departure from his positivist outlook. Masaryk’s lectures on practical philosophy attest to this fact. The reason for his departure from a positivist stance was due to the metaphysical nature of his concept of psychology. (shrink)

This article proposes a new acrostic (SAPI) and telestic (SOIS) at Laus Pisonis 227–30. Their position opposite one another is an indication that they are to be read as a single sentence and an admonition to both dedicatee and reader that poet and patron need each other to gain eternal fame. The telestic allows us to reconstruct the poet's usus scribendi of the reflexive possessive pronoun suus.

The first part of the essay explores the relations between the will and practical reason or judgement. The second part takes up decision in the realm of belief, i.e. deciding that such and such is so. This phenomenon raises two questions. Since we decide that as well as to, should we speak of a doxastic will? Secondly, should we regard ourselves as active in the formation of our judgements as in the formation of our intentions? The author's answer to these (...) two further questions is ‘no’ and ‘yes’, respectively: the boundaries between the active and the passive are not marked by the will. (shrink)

According to metaphysical coherentism, grounding relations form an interconnected system in which things ground each other and nothing is ungrounded. This potentially viable view’s logical territory remains largely unexplored. In this paper, I describe that territory by articulating four varieties of metaphysical coherentism. I do not argue for any variety in particular. Rather, I aim to show that not all issues which might be raised against coherentism will be equally problematic for all the versions of that view, which features far (...) more nuance and diversity than is typically ascribed to it. Fear, sadness, surprise, anger, lust and love - virtually nothing was more important in the paintings ofthe Golden Age than convincingly depicting human emotions. In this publication, the Frans Hals Museum and Rembrandt expert Gary Schwartz present a selection of masterpieces in which these emotions are sublimely portrayed. According to seventeenth-century connoisseurs, the beauty of a painting was not even half as important as the passions that could be seen in that painting; they formed the soul of the work. (...) This book strongly challenges the Western philosophical tradition's assertion that humans are superior to nonhuman animals. It provides a full and direct moral status of nonhuman animals. The book provides basis for a radical critique of the entire trajectory of animal studies over the past fifteen years. The key idea explored is of 'felt kinship' a sense of shared fate with and obligations to all sentient life. This paper provides an analysis of the intrinsic/extrinsic distinction, as applied both to properties and to relations. In contrast to other accounts, the approach taken here locates the source of a property’s intrinsicality or extrinsicality in the manner in which that property is ‘logically constituted’, and thus – plausibly – in its nature or essence, rather than in e.g. its modal profile. Another respect in which the present proposal differs from many extant analyses lies in the fact that it does (...) not seek to analyse the ‘global’ distinction between intrinsic and extrinsic properties on the basis of the ‘local’ distinction between having a property intrinsically and having it extrinsically.
